CFTC Letter No. 26-28, issued on 1 October 2026 by the Division of Market Oversight and the Market Participants Division, extends the no-action positions previously set out in Staff Letter 24-11. It supersedes Letter 24-11, which may no longer be relied on. OptAxe Limited is listed in Appendix A to Letter 26-28 as an Eligible UK Facility.
Under the Division of Market Oversight positions, the Division will not recommend enforcement action against OptAxe for not registering as a swap execution facility or designated contract market, or against counterparties subject to the trade execution requirement that execute in-scope swaps on the venue. Reporting, swap trading eligibility and clearing requirements under the Commodity Exchange Act and CFTC regulations continue to apply.
The positions run until the earlier of 31 December 2027 and the effective date of any Commission exemptive order under section 5h(g) of the Commodity Exchange Act for multilateral and organised trading facilities authorised in the United Kingdom.
